Purpose of the Service

EsyLoads is a matchmaking solution that enables professional carriers and shippers to exchange road freight opportunities.

The Platform acts solely as an intermediary and is never a party to the contracts concluded between carriers and shippers.

Account Creation and Management

Account creation is reserved for professionals who possess full legal capacity.

When you register, you agree to provide accurate, complete and up-to-date information and you remain responsible for maintaining the confidentiality of your login credentials and any activity conducted through your account.

• Notify EsyLoads without delay of any change affecting your company or mandatory authorisations.
• Do not share your access with unauthorised third parties.
• Ensure that the documents supplied for verification purposes are genuine and current.

Use of the Platform

You agree to use the Platform in accordance with applicable laws and standard industry practices.

• Do not publish content that is misleading, incomplete or contrary to public order.
• Do not divert the data available on the Platform for unlawful or competing purposes.
• Honour the contractual commitments you enter into with other users via EsyLoads.
• Refrain from any attempt to intrude on or disrupt the proper operation of the service.

Financial Terms

Access to certain features may be subject to subscription fees or commissions as described in the customer area or in EsyLoads commercial offers.

Amounts are invoiced in line with the communicated billing terms. Late payment may result in suspension of access to the service.

Commitments of Carriers and Shippers

Each carrier warrants that it holds the licences, insurance coverage and operational capabilities required to perform the proposed services.

Each shipper warrants the accuracy of the information relating to posted loads and compliance with the conditions agreed with carriers.

Responsibilities of EsyLoads

EsyLoads strives to provide an available and secure service, without guaranteeing the absence of interruptions or errors.

EsyLoads is not responsible for negotiations, the performance of transport contracts or any direct or indirect damage arising from exchanges between users.

Content and Intellectual Property

All graphics, trademarks, software and content made available on the Platform remain the exclusive property of EsyLoads or its partners.

You grant EsyLoads a non-exclusive, royalty-free licence to host and display the professional content you publish within the service.

Security and Privacy

EsyLoads implements technical and organisational measures designed to protect personal and transactional data.

Detailed data-processing arrangements are described in the Privacy Policy. You must ensure that your own systems provide a comparable level of security.

Suspension and Termination

EsyLoads may suspend or terminate access to the service in the event of a breach of these Terms, fraud, non-payment or behaviour that jeopardises service security.

You may terminate your account at any time by contacting support. Obligations incurred prior to termination remain enforceable.

Service Changes

EsyLoads reserves the right to update the service's features, interface or financial terms.

Any material change to these Terms will be communicated at least thirty (30) days before it takes effect. Continued use of the Platform after that date constitutes acceptance of the new terms.

Governing Law and Dispute Resolution

These Terms are governed by German law.

Any dispute relating to their interpretation, performance or validity shall fall under the exclusive jurisdiction of the courts of Düsseldorf, subject to mandatory legal provisions.

Before taking legal action, the parties shall endeavour to settle the dispute amicably and may use a mediation service.
